Our Subdivision has elected a board after 7 years of not haveing one. We have a private water company that contols the water wells for the subdivision which has been in place since 1973. We have no firehydrants in he area and poor water quality.

I am wondering, what (if any) control does the HOA have over the water company? All billing is done by the water company and they are a private LLC in Texas.

Are they the only company capable of delivering water to your association? If yes, one may have to live with that "devil".

Who owns the water wells? Who owns the pumps and infrastructure the water company uses. The HOA probably has no control over the water company unless they own they own the wells and equipment. Is there a contract between the HOA and water company?
