Does anyone know anything regarding For Sale Signs posted on lawns in NC. Our covenants states no signs allowed in yard. Is there a NC law allowing Realtors they can put their signs on lawns.

Have you researched the topic? NC statute? Ask the question of the Association of Realtors?

Are you on the board of your association?

Have you asked your Board?

There are some very restrictive areas that don't allow signs, even for sale signs, but MOST associations allow for sale signs - some may have restrictions on size, etc, though.

Can you post an excerpt of your CCRs that restrict in this manner?

We don't allow For Sale signs. Only Open House signs when they're scheduled.

Our Covenants reads "No billboards or advertising signs (including without limitation "For Sale Signs) of any character shall be erected, placed, permitted or maintained on any lot or improvement thereon except as herein expressly permitted. It is permissible for Declarant or its designee to erect signs and flags which identifies the development and promotes the sale of properties within the development, at the entry, on berms and at the model center." None of our covenants have ever been changed. They are the same as the builder had the homeowner sign for at time of sale.

I have not checked with the NC Realtors Association. I was one of the original Board members and have tried to help our Board regarding our Covenants, but, they aren't interested. They run it like they want to. I finally gave up. They want answer any of my emails. I have asked them about the signs and I'm waiting for a reply.

The NC Planned Community Act only addresses American and State flags and political sign displays. It has nothing regarding For Sale Signs.

Sounds like it is up to the Board to follow up and issue violations.

You may have to go through significant letter writing, then hire an attorney to write a letter, then see if the Board "gets it."

If you don't want to do this - and, there are no others who share your interest, and will contribute to the cost of the attorney, then you could start a recall of the Board - different topic, more labor intensive than attorneys - but, a lot less expensive.

Our governing documents did not allow for sale signs while under declarant control.

Our association allows one 3' x 5' For Sale in the yard. However, most relators put in a slip sign instead.

Our (ancient) CC&Rs don't allow real estate signs, but our city does and limits the size. What about your city, Nancy?

I have lived in associations where all signs were banned. Did not matter what type sign. My present association allows realtor signs but limits their size.

From our SC Covenants:

Section 4. Signs. No sign of any kind shall be erected by an Owner or Occupant within the Community without the prior written consent of the ACC except (a) professional security signs consistent with the Community-Wide Standard* (b) any signs required by legal proceedings, (c) reasonable and appropriate signs erected by the Board, (d) builder marketing signs, and (e) signs erected by Declarant. In connection with a bona-fide offer to sell or lease a Lot or residence, one (1) professionally lettered "For Sale" or "For Rent" sign consistent with the Community-Wide Standard shall be permitted provided the sign has a maximum area of six (6) square feet and a maximum height of four (4) feet above ground level, and (ii) the content of the sign states only that the Lot or residence is "For Sale" or "For Rent" and the name and telephone number of the person to contact for additional information. "For Sale" or "For Rent" signs including any additional information shall not be permitted in the Community. Notwithstanding anything provided herein to the contrary, no sign shall be displayed on or from within any structure on a Lot.
