I am the Treasurer of a 40 unit HOA complex built in 1973. Unfortunately the Bylaws and other documents are as old as the units themselves. As the properties age we are seeing more maintenance issues, specifically some water leaks in common walls. The Board position has been that owners are responsible for all piping that serves only that unit. Recently we have been challenged on this opinion. Unfortunately even the Board finds the documentation confusing/ambiguous. I'm hoping there is someone out there who has already solved this. I have attached a file with the two applicable sections.

you may have ancient document, but for now, that's where you may need to start. You don't say if this is is a high rise of townhomes, but it may be some sections that are the association's responsibility, while others are the homeowner's responsibility. The location and perhaps the cause of the leak may determine the answer.

In addition to talking to your association attorney, you may need to see if there are any plumbing line diagrams or something was filed with your city or county agency (not sure which one, but whoever issues building permits may be a start). Maybe your city or county water department might know.
