Board voted to shut off barcodes of delinquent homeowners.According to HOA statutes in Florida, 720.305,
This is a illegal.???A friend of mine who used to be a HOA manager said that the delinquent homeowner can use their card pass instead.
They can still get in but it’s inconvenient to come in on the visitor side.
Can anyone tell me if this is illegal (and clearly ineffective). Thanks

I know from experience that owners can be locked out of amenities, but they can't be denied entry into the community to enter or exit their property.

From my understanding, this would be allowed.

The member has access to the development though the visitor gate.
Hence, ingress and egress has not been denied.

Typically, access to amenities can be denied to those who are not current in their assessments.

Yes. The HOA can prevent owners from using amenities especially since your NOT paying for them. That is what you pay dues for. They can't prevent you from entering and exiting your property. They just don't need to give you the SAME treatment as full paying members. Which in your case is to use the guarded gate and not visitor entrance.

You pay for what you get in a HOA.

Melissa, you don't know that.

My understanding is that the issue is over late charges and additional fees.
Mark may or may not have been sending in his assessments.

I think I need to clarify. I have never missed a payment and this is not about a dues payment this is about a late fee added to a payment that was never brought to my attention by a coupon. It was an assessment that was brought up out of the blue and never brought too many with the homeowner attention.When we paid immediately upon knowing about it, we ask that the $25 late fee be removed. This mob mentality board Didn’t even reply and then took a vote for those with the late fees to pay whatever it was. This was a clerical office error. As far as people who do not pay their quarterly dues I agree amenity should be taken away.

Are you saying the assessment in question for which there was not a coupon was a 'special' assessment, not the regular, periodic assessment?

If so, did you receive an invoice or some other notification?
