Do any of your HOAs require homeowners to provide their 'rental agreements' when leasing out their homes?

Absolutely! I own 4 rentals in 4 different developements and all require the leases to be kept on file with the owners folder. Part of that requirement has to do with the Association's liability policy.

Could you elaborate on this? How would the Association be held liable? Isn't it the homeowner that is responsible for their renters. We are a townhouse community of 124 homes. One reason we are going to require this is so we know which homes have renters.

Yes Paul,
Knowing who is in any unit is important. The liability statement that I made is in reguards to the worse case scenerio of someone getting injured on common property, like if someone useing the clubhouse or pool or falls in the back of a building, they would probably try to sue. In a gated or private community, if they did not have the right to be on the property, then it is an asset in the community's favor. So keeping track of anyone who has the right to the association property is important.
My rental unit has interviews with potential residents, be they buyers or renters, which is sometimes argued as to why it is done but it gives everyone a chance to meet some members and also, the reading of important rules, gives the community a chance to let them know that we do have restrictions. Then because we are security and emergency monitored, we are required to have a roster of everyone living within the gates.
But I just think that in general, it is a safety plus, knowing who is living amoung us, WITHIN REASON of course.
