In our Association, the local Housing Authority owns two townhomes. They have not paid the HOA dues in a long time. I'm not sure how long or for how much. Our manager has tried contacting them and is getting nowhere. I did find the contact info for the Director and their Board of Commissioners. This is our next step.

Our neighborhood is already upset that HA owns to homes that are given out to section 8, which has never benefited the neighborhood, only brought it down. The people are rude. They don't take care of the houses, nor abide by our HOA covenants. Never has HA sent a representative to our annual meetings or been involved with our homeowners association.

Now they are not paying their HOA dues.

Paul, when they purchased a unit they agreed to the CC&Rs. Enforcement is the same as for any other owner. What penalties have occured to date on the delinquent assessments and for violations to restrictions?

The board has a fiduciary duty to uphold the HOA document's. They have to follow the procedure for the HA collections as anyone else in the community.
If the renters in these homes are not following the covenants it is also the BOD who are responsible. The HA can be fined as everyone else. If they are fined or sanctioned, they will pay attention to who they also to rent these properties.

You don't seriously believe the HA would attend a BOD meeting or be involved with the community do you? The HA, as you say, don't pay their dues and don't enforce the documents with the renters, why do you think they are going to take part in any aspect of the community. Not to say they shouldn't, but if you have indifference with homeowners how do you think the city feels.

And this is another problem that is waiting in the wings to become a full scale battle. I have a sneaky feeling the HA is going to do more and more of this. It certainly makes sense. The HA looks good on paper, have wide powers, no acccountability to the neighborhood, and have active interest of the local and federal legislatures because of the funds they control. The mortgage debacle that was created by a whole host of people out to make quick money, could not have come at a better time for the HA to place all these people in a good enviroment and realize there will be conflict and they will be the sure fired winner, and maybe, a nice enviroment will help the folks they place.
Right now it appears about all the HOA's can do is try to help these folks become more social and responsible towards the community. So, another outreach committee will be appointed by the HOA's, some will work and some won't for what ever reasons. The results into the future will be proportional to the efforts extended by the HOA's and any success story will be showcased by the HA. The apathy seen throughout the Hoa's and the recent bad press will make the job more difficult, but maybe it will wake up those owners that refuse to get involved in Community affairs, as this HA action is surely a community affairs problem.
