Our HOA has seven board members. There are five vacant board positions for the next election. How many votes does each homeowner get? Do they get five votes each to spread among the candidates?

Five votes spread among the available candidate assuming there are at least 6 running for the board. If there are five or less running for the board, there is no election. The five or fewer candidates automatically take office on the date of the scheduled election.

What Tony wrote might be the case in FL, but isn't in CA, so I don't know what the case is in WA.

Interesting. How does it work in California? If there are not at least 6 members running, why hold the election? Would CA allow a homeowner to cast all five of their votes (assuming five candidates) for one or two of the candidates? What if two of the five candidates get no votes? Does the board come up short of the seven board members even though five are willing to serve?

Florida Statute 720.306(9)(a) "An election is not required unless more candidates are nominated than vacancies exist."

FL makes complete sense, Tony. Would love it here. And since CA isn't the topic here, I won't spend time showing that winner by acclamation is not the case here, unless... The question is: what's the statute in WA, or in Barbara's governing documents, probably her Bylaws.
