Have lived in my condo 4 years. Neighbors moved in above and installed hard flooring (i believe "floating" type) that according to condo by-laws are not allowed. This family and their toddler make tons of noise. Told them directly, no action. Told board, and board is sending rep from management firm to visit the family and see if their claims to have insulated this floor are true. Can they do that? The condo rule states that the 2nd floor units must have carpeting of the quality that was originally in the units or better in all areas except for kitchen, bathrooms and laundry room. These folks have hard floors thru-out!!! HELP!

LizD: A 'floating' floor is made up of wood/laminate planks which are placed over a type of plastic-type material to 'cushion' the wood itself. However, does this material have claims to being an insulator against noise to the downstairs neighbors?

Even if it does, your documents, if they do indeed ONLY ALLOW carpeting, override any claims this flooring might make. The Board needs to enforce the covenant as written or else take a vote of residents (process dictated in documents) to pass a change to the existing bylaws.

I have another condo besides this one that I have written about that needs a turnover, it is established and we have the same by-law......Now it happened in a unit that they put in hardwood floors and the board made them cover it...and warned that if it was a problem they would have to come out.

The first floor can have any kikd of flooring but the second floors have to have carpet even in the kitchen and bathrooms, uck, so many are putting tile but covering with a rug......
