Our HOA in Colorado has existed for more than 10 years. We have a "maintenance free" housing area within our HOA that is not a "sub-HOA" and one that is. The original governing documents were set up that way for some reason. The area is that not a "sub-HOA" would like to change/amend our governing documents to make that change. Is that possible? What is involved?

I've never heard of "sub HOA" - by "maintenance free," do you mean all the units' exterior and landscaping is the responsibility of the association to maintain? Do the people who live in this "sub HOA" now want to join the larger HOA? If so, there will be implications to the association budget as well as the documents (your Bylaws and CCRs as well as whatever regulates this sub-HOA).

This is not a job for amateurs (amending documents never is), so don't cheap this out and think you can rewrite the things on your own. You will need your association attorney to work with you on this. IN the meantime, review your own documents to see what it says about amendments. Usually a large percentage of homeowners have to vote to approve the changes.

There are many, many sub HOA in the United States. There are generally part of a large master community. How where I live, their are three large master communities each with a minimum of 6 sub HOA's. These arise when there are multiple builders and different mixes of homes, SFR, Town, condo, patio. The one down the street, owners pay three different fees, master, school and sub.

I understand sub-HOA's and they are quite common. Typically a sub-HOA is their own HOA with dues/budgets and often with their own amenities but they also pay a "fee" to the Master HOA for various things such as more/larger amenities, maintenance, etc. Often the President of the sub-HOA is also on the BOD of the Master HOA.

What I might understand what a "maintenance free" sub-HOA is, I doubt it is such. As example, roads leading into it, etc.
