Hi,
About two months ago our vehicle was towed. The current rules state that all vehicles have a 15-minute courtesy parking time in front of buldings.
The problem with this is that the time stated on the "Notification of Violation" is 1pm ... we have a receipt from a supermarket that's about 15 minutes away stating that our credit card has been swiped at 1pm on the same date.
So in other words the car was not parked in front of the building at the time stated. The earliest we could've gotten there was 1:15pm, after which we proceeded to unload the car and carry the groceries upstairs... a task that took no longer than 5 minutes. When we returned downstairs the car was gone.
My husband went to the gatehouse to find out what's going on, and was told that the car has been standing there for longer than 15 minutes and has been towed. My husband demanded a copy of the report and at that time was told that no such report existed. He exchanged some heated words with the security guard on duty and then called car service to go pick up the car.
About a week later we stopped at the Management Office to file a complaint stating that our vehicle has been wrongfully towed and that we should be reimbursed for our expenses. The secretary promised to look at video footage, report and key card entries.
Several weeks later we were notified that the angles of the video cameras did not provide a view of our car, the key card entries do not show us entering the property until 2pm (!) and that they are standing by the hand-written report that magically appeared a few days before. Oh and the times stated on the report do not correspond to the time on the "Notice of Violation" and states that the time that the vehicle was towed is AFTER the time we already picked it up from the towing co.
Everyone in the community suspects a nice little side towing business going on however obviously noone can prove it.
Do we have any options to get this resolved?? It just seems rediculous that we should even have to fight something so blatantly wrong. I've tried bypassing the Mangement Office with their dimwitted staff and wrote an email directly to the president of the HOA board, but I don't know what my chances of getting a responce from him are.
