In Florida, Architectural Review Guidelines can be changed by a Board Vote.

A question has comer up as to notice to homeowners.

Does a special mailing need to occur or including the information in the meeting minutes and updating the ARC on line sufficient?

Some seem to think we have to give 14 days notice.

Hi, Art. FS 720.303(2)(c)2 says a 14-day notice must be given in advance of any board meeting "at which amendments to rules regarding parcel use will be considered". The question is, are your ARC guidelines considered "rules regarding parcel use"? In my HOA I'm pretty sure the board would say "close enough" and do a 14-day notice and include with it a meeting agenda and a copy of the proposed ARC guidelines as well. Whether or not that's strictly required based on the wording of the statute, I don'k know.
