Our units have open decks/ balconies that’s are typical decking. The highest level has direct sun. This isn’t new and in fact I live on this level. We have had rogue owners do bizarre things and use coverings that are not allowed in the rules. The justification is that the deck is hot. I use an umbrella which is allowed and helps. However our only allowed items to the railings is a fine mesh gray.wire. It’s outlined in our rules and has been there for years nothing else is allowed. .
One owner has this plastic camouflage looking stuff which is an eye sore. SHe is now saying its for her own privacy and to keep her deck cool.

#1 - suggestions to consideration as an option?

#2 is privacy an HOA concern?? SHe bought this unit as it is next ot a business and up front.

I am asking for ideas to this issue. Our buidling has open wrought iron railing, 4 inches between the rails,. The chicken wire was approved to keep small pets safe from falling through and under.

The board is open to changing the rules, but the current eyesore is being addressed. Any suggestions for another options would be appreciated.

Until then, you have to enforce the rules, so if umbrellas are ok and other stuff isnt, that's what you go with. I've seen several online places that sell patio umbrellas and some are better than others when it comes to shade. In fact I seem to recall one which has a small can attached to the pole. Can't remember if it's operated with batteries or solar energy, but people can go online and look for this stuff. Or go to a home improvement store.

Ditto for privacy screens. I've seen some that really look nice, almost like regular fences. You can look at a few and perhaps set some standards on color, size, if they can be kept out year round, etc. Some people use privacy stands to shield their garbage cans.

Regarding privacy, that may or may not be an HOA issue, depending on how many people are involved and how privacy is being violated. Usually I start with considering it a resident-resident issue that the HOA will stay out of, unless several people complain about the same person. In some cases, it may be an issue for the police if you have a peeping Tom situation.

For now, you may want to deal with that on a case by case basis. If you start seeing an increase in complaints, you may see a pattern emerging and then address it.

Hi Michelle,

This may be a good opportunity to change the rules if all parties can come to a reasonable agreement. I do understand her desire for more privacy, but since her current solution is clearly violating the current rules, this cannot remain.

With Marshall. Change the rules OR call her to a hearing, fine her, etc. Her privacy is not the HOA's obligation.
