We are a small 30 home development in Florida with a big problem. I wont' go into details, however we have a serious issue with foster children from one home. Now I understand that someone else wants to buy another home and run it as a foster home.
We are contacting an attorney to see just what our legal options are. Does anyone have any insight as to what we can do to stop this?

The first thing that you do is to consult your Documents and see if you are a "Single family Residence Only" community.
Also in your docs, there might be a paragraph stating that "no commercial business may be held in any residence"
These will be about your only outs for this as it is considered a "business" But your best bet is the Attorney. Good luck to you.

Jim,

You say a foster home but do you mean a foster placement center? A foster home has one or two parents with as many children residing in the home as bedrooms will allow. 2 of the same sex per bedroom. A placement center can pile 3 or 4 of the same sex in a bedroom but they are run by the state.

If it is a foster home you do not have many options. The home has to be inspected and approved by the state for placement of these children. They can be in foster care from anywhere from a few days to many years, depending on the situation with the children's parents.

In a placement center, which is a business, but a business run by the state; these are more or less half-way homes. The kids are waiting for placement in a foster home or it may be a short separation from the parents.

If it was a business run by the state, I doubt they would move into a HOA. If it is a foster home they have to abide by the rules of the HOA just like everyone else.

devil's advocate for bit...imagine the bad press you could get if you try to shut this down. After all they are providing a service to children in need. I am not saying it is right, I think you should look at it from a PR standpoint.

I am not sure of all the steps you have taken, but the first one would be to talk to the owners of the home, express your concerns and find a compromise that can work. Just my two cents.

Yeah I agree with Donnas, first of all review your documents and see if you are a single family residence' community.

Since laws change, it's best not to reactivate old threads because what was good advice in 2007 may be bad advice today.
