Ours is a community in Texas. Our builder didnt not provide any electrical connections at the entraces and community monuments and now the HOA wants to get the electrical connections done.

One monument is at the intersection of two streets and the power for it should be drawn from the electrical box which is inside the community in front of a house and is situated between the road and pathway. The contractor wants to have a underground conduit drawn from the electrical box to the monument using a boring machine and the conduit goes between the two houses next to their fence.

The home owner is not objecting to it, but wants the HOA to get the survey done again and include the new easement into their plat so that in future it will be known to everyone. Contractor is saying it will be too costly to have this remapped.

Any suggestions?

Is there any reason why the current survey can't be incorporated into the plat if it's accurate? Check with the recorders office or whoever records plate in your area - this could be a simple fix. I'd try that before spending more money. If you can't amend the plat, I think the homeowner might want to come up with a specific reason he's concerned about this one.

As for the contractor, what does he care as long as he gets paid for the work he's being paid to do? What are the connections for anyway - is it to light up a sign? Perhaps the board could consider getting a sign that runs on solar power and skip the connection work altogether.

All our plats show easement at the back of the lot, but not on sides.
Not sure if there are any easements going on the side of the houses.

If the easement agreement is filed with the county land records it should show up in a title search making the new survey unnecessary. It may be the homeowner doesn't understand that. However, if the homeowner wants a survey as a condition of granting the easement, that's reasonable. You are just talking about surveying one property, correct?

If it is solely for lighting the monument sign at night, how about solar lights? There are some pretty sleek looking lights that are commercial grade for projects just like these, and it will save you a boat load of money on an electrician to trench conduit and pull wires..
