We bought into a Condo with an HOA that was later declared a Townhouse, the cost rose to the maximum that it could yearly and supplemental charges for the pool and clubhouse were placed and raised as well to the point that perhaps 20 of the 66 units in our HOA use the pool, we asked the HOA to replace windows that had extreme leaking and were told that they didnt do that, we asked for help with the roof leaking to the point that our ceilings are falling in and discolored, we were told that it was behind the studs and that it was our expense, carpenter ants began eating into the window casings of our home and we were told that it was our problem, we tried to explain that the siding was rotted out due to the neglect on the part of the HOA after we repeatedly complained and asked for help, the biggest mistake we made was that we stopped paying our HOA dues and began doing the repairs ourselves, we took the HOA to small claims court where we represented ourselves and they brought thier attorney and paralegal, what we found was that the HOA is broke, according to them, not enough to mow the lawns twice, the declaration that is filed with the courts is now outdated and expired over 5 years ago, We lost because of a "in the best interest of the HOA" clause in the expired declaration, without any warning at all they immediately seized our bank account and everything in it, we have had to abondon the account and open a new one allowing them to keep our money above and beyond what we owed. the condo laws do not apply in our case, we were changed to a townhouse status, tell us, we are in our 50's and bought into this train wreck because we didnt want to paint, mend roofs or shovel snow, for our $140.00 month, we get trash pickup and paper bags to police our areas when debris accumulates, after we paid to replace the deck out back, we asked if they painted them, we were given a bucket of paint, they took it back after we got the first side of the fence painted. What can we do when the declaration filed with the court has not been renewed in nearly 30 years and our property is collapsing, the foundation cement is flaking away, we have termites, for the leak in our living room they gave us a drop cloth to protect the rug with and the HOA has no money. what happens when an HOA has used up its funds and the tennis court is condemned, the fire place is collapsing and they just "take" your money and do nothing to account for it, I know that not all HOA's are this way, an HOA is a great concept but what do you do besides wait 4 years to vote one out and of the 14 members of this HOA, there positions or offices they hold are stagnated so that they are always voting themselves back in?
