Good eve all................just returning from visiting a neighbor who has been informed that the State of Florida will no longer make arrangements for mediation regarding HOA'S....He has an order for mediation and am looking for someone here in florida that be able to guide us to one to hear this case....... I can give you a 5 county radius if anyone who belongs to this forum can help....St Lucie, Martin, Palm Beach, Okeechobee and Indian River........ Any help will be SO APPRECIATED...............the sooner the better........ I do have an email account set up for HOA business if you care to send me a private email [email protected]

I just read an article that Florida has removed the Omsbudsman from Palm Beach County which is the district that you are in.
Contact Dept. of Business & Professional Regulation. Division of Florida Land Sales.
That is the dept that regulates H.O.A's

DonnaS.............Ombudsman are for Condos only in Florida...They are not used for HOA'S.... Effective July 01,2007 when you file a petition for mediation with DPBR they review it only then issue a letter to you stating that this issue has credence and now needs to go for mediation...DPBR DOES NOT provide the mediaiton any longer..It is up to the party filing the action to seek out a mediator to hear the case as a PRESUIT to filing in civil courts now..THus the reason for my asking if anyone knew of a good mediator in the 5 county area I listed......LindaC

Who is requesting the mediation? I understand the originator is supposed to provide the names of 5 mediators per Senate Bill 902. Is the neighbor filing for mediation or is he the recipient of the notice?

KevinK1-- My neighbor filed the petition for mediation against the HOA...he has an order from the State telling him that his case meets the criteris for mediation.He now needs to find one to hear the case....Thanks LindaC

I'm in Ocala, we just completed a court ordered mediadtion.

Fla. Statute 720 is the authority.

The mediator is here in Ocala.

Your attorney or the plaintifs attorney should select the mediator and then you get to agree on one.

You wil split the cost.

Look for "Dispute Resolution Management" firms.
