We're part of a small HOA in a rural setting. The majority of homeowners would like to delete a majority of the provisions in the CC&Rs and retain a "bare bones" version. Essentially, we wish to maintain the minimal common areas, provide liability insurance for them, require homeowners to maintain their front yards, etc., and allow people to use their one acre properties as they choose -- as long as they adhere to 'town law'. We believe town law provides sufficient restrictions, i.e., subdividing, number/type of animals allowed, building restrictions, etc.

We propose to do this by 'amending' and filing the CC&Rs. Our current CC&Rs require a vote of 75% of homeowners, which we feel will be an easy number to achieve.

We're in AZ. What problems might we encounter?

There are no Arizona laws against doing this that I know of. If you have the required percent of owners in favor of this, there should be no problems. There is growing support for HOAs sole function to be maintaining common areas only. Looks like that's what you're heading for. Good luck. Harold
