I hope you are all well, our building from the 60's cast iron pluming has finally began to collapse, and now a major work will need to be done, brake walls and floors what ever, so I did find out that Morgan & Morgan has won a lot of lawsuits when the insurance company refuses to pay for the expense, now it seems the insurance company is willing to pay but of course not inside the units? Has anybody ever dealt with any similar situation?

Hmmm ... Confused here why an insurance company would even consider paying for a maintenance item such as replacing plumbing installed in 1960’s??? Do you have a link to the lawsuits you are describing?

I expect that the Insurance company is paying due to failures (vs. preventative repairs prior to a failure).

I expect that you are discussing the Associations insurance.

Association insurance would cover damages to repair the line in the common areas.
Repairing lines within the units would be the responsibility of the owner of the unit (or that owner's insurance company).

An owner could make the argument that the item would not have failed had the Association done regular inspections in a hope for a finding of negligence on part of the Association. However, this may cost more then the repair itself.

Have the owner contact their insurance company and let the two insurance companies fight it out.
This way the issue is resolved and everyone can go on with life.

I sense the OP is referring to litigation like the Kitec litigation was.

I don't think insurance companies pay for repair of 60 year old cast iron plumbing. It's a known issue all of the country.. that's why hoa's are supposed to build up reserve funds..

preventive maintenance is done as a matter of course over the years. insurance doens't pay for maintenance that I know of.. we are talking about drainage lines,, not supply lines.. so it's not like the inside of the units get flooded suddenly..

Any money insurance might pay towards replacing the 60 year old cast iron pipes would certainly be reduced by the expected life of the cast iron pipes.

I.E. I can't drive my tired 200,000 miles on tires rated at 100,000 and expect the tire company to replace them under warranty.

There may be more information that you haven't provided as to why you think insurance would pay for replacing old cast iron pipes.. Please tell us. Our condo's have old cast iron pipes, and we are slowly but surely having to replace one building at a time as they lines under the building are no longer serviceable.

I do not see this as an insurance unless one had a policy that specifies otherwise. It is a maintenance cost issue, not an insurance event.
