Hello:

IM in Florida 28 units....each unit is assigned to one parking spot per unit and there is a blank parking spot next to each assigned parking spot...think the board should assigned two spots for each unit....can the board do that or they have to charge the docket and have an atty to change the declaration as well......even thow the board dont follow the declaration.

We have some home owners that have three cars and they usual take other family members spots other then parking in the visitor spots. Mind you the declaration only allows two cars per unit.

We have those empty spots, next to our assigned spot assigned as "Guests. Any family having more than 1 vehicles gets the extra spot needed at the ends of the rows. Alot depends on the size of your parking areas. And YES!! the B.O.D. can assign them as they feel is needed unless your docs state otherwise, which I highly doubt.

Thanks for the info DonnaS- we just have a homeowner that has three cars and I have two and I have been parking in the same spots with both cars all the time...the homeowner with the three cars is very inconsiderate and parks in the others homeowners spots that have only two cars..

That's not very nice of him. Talk with him first if you think that he is receptive to a suggestion. If not, your Board or Property manager will have to send him a letter, of course hopeing that there is a written policy . If they have been just "winging it", then they will have to write one up asap. Some people just can't figure it out that they are not the only ones in this world.

DonnaS: we had a meeting with the board and manager and they allowed him to have the 3rd car..they said that if you have a 3rd car and a other homeowner writes letter to board allowing that person to park in the un assigned spot then you can have the 3rd car.

Its states in the declaration that 2 cars per unit and not to take more then two parking spots...I had suggested to the board and the manager to sign two spots per unit instead of one and he stated its too costly to get that done with the dockets and having to change all the updates...otherwise he was not interested in doing that at all.

We had the exact same problem in our community, except our doc's say each homeowner is afforded two parking spaces in front of his/her homes.
We went for assigned parking because, several homeowners have muliple cars, and we have plenty of overflow parking.
However! the selfish ones will not use the overflow area.
We were told by our attorney we had one of two options we could take.
1) The Board of Directors could independently assign two spaces per home, and force the ones with many vehicles (some with four or five vehicles) and take the chance of being sued. We are a private community with the common areas being controlled by the board.
2) Let the community decide if they want assigned parking, but we would have to have 67%
of the homeowners to agree.
We are a community of 167 homes, and have fourteen rented out by the homeowners. (They could care less) Others have more then two vehicles, so you know how they were going to vote.
We were able to get 47 to say yes. The others said they would like to have assigned parking, but they were not able to come to the special meeting. They want someone to come to their homes with the petition, along with a notary. (the forms have to be notorized) We can't do that.
We have since been told told by our attorney we should have gone the way of the board, because no one is likely to sue over a stupid parking spot.
We can't do anything now, because he said we started the other process.
If you have a board, and you are making decisions affecting common areas, go with the board.
