Our annual meeting was held Sept.8 a new sec./treasurer was elected. After the meeting the pres. vice pres. and exe. committee resigned. The newly elected sec/treasurer hasn't been heard from since the meeting who are we suppose to give these resignations to. (I was the pres. and have them in my possession)

BB2 Sounds like a few board members are displeased with the election of a new sec/treasurer. Maybe a better strategy than resigning would be to face the new officer and try to resolve any differences. That would probably be the best course for the ass'n. If that doesn't pan out, maybe your bylaws empowers a majority of board members to oust the newly elected member. Finally, if you have a management company, that would be one place to tender your resignations. RichardD

BB2, since no Board member is available to receive the resignations I suggest you need to appoint Board members to fill the vacancies and then give the resignation letters to them. Why are you all resigning?

Who's in charge here now? If the Pres and Vice pres both have resigned, then who is left? How many Board members are you required per your docs? What State are you in? This information will give us some basis for our answers as many states have statutes on how to handle this situation.

Are there enought Board members left to form a quorum? If so, then the remaining Board members can appoint members to fill the open positions. If not, you will need a "special election/ meeting to fill the Board openings.

But I totally agree with Richard D. A cowards way out is to quit. These guys shpould stick to the positions that they held and work together altho sometimes so many hard feelings are present that things cannot be worked out. But someone has to bite the bullet and get back on track.

Hopefully this helps. This is a very small HOA (27 votes ) President, Vice Pres, Sec/Treas. Ex.Committee (1 person). We did not resign because a sec./treas. was appointed.The new sec./treas. hasn't bothered to put their name on the checking account let alone the few bills that need paid. That is the reason for resigning no one wants to be bothered with keeping things running.The water system requires licensed operators keeping these licenses requires class time etc. maintaining the well to state and federal standards is time consuming (these people are not compensated)the trash bin is on private property in order to keep it there someone has to make sure the area is neat and tidy no junk around it. Can't say the list goes on it doesn't what it comes down to "You can't make people care" as long as they are getting everything for almost free why would they want to contribute. Dues are $250.00 per year where can you get water and trash for this amount?

BB2, you can hire a mnaging Agent to do those jobs. This prevents burnout of Board members. Anyone can get tired of providing free labor after awhile. Particularly when no one else steps forward to help.

This is my point no one wants to contribute their time and yet expect those that do and have done for years to do all for free. And a big fat NO to hiring anything done. I/we asked for $75.00 a month to maintian the well rather than do that past due dues in the amount of $1500.00 dollars were forgiven and well maint. turned over to individual who contributes nothing and has never involved themselves in the water system. This is also the individual who has on many occasions stated "I am going to hock up to my well and get out of the Village"
