We are a HOA in pompano Beach Fl. with 44 Town homes 15 unsold and out of the 44 12 are rented by the developer. We need 90%
to take control which at present is not going to happen for a while.
My question is .. Is the developer responsible for all cost accruing over and above the collected monthly fees.
Such as street repair, Lighting, we have a sewage pump (do we pay for replace or them?) Another words are we reasonable for
anything other than general upkeep. Any help would be greatly apricated

It depends. Once the owners take over you will all be responsible for the expenses of the HOA. So if the developer was to put in a "pool" then you all will have to pay for the maintenance/upkeep. The developer would have paid for the pool.

Do you know what your dues your paying now is it cover? It may cover the expenses of the HOA already.
