We have a Road Maintenance Association created by the original CC&RS. We do not have an HOA. There are changes that need to be made to update the CC&RS. My question is the proper way to go about this. Is the Road Maintenance Association able to make this update legally?

This will depend on the language in the governing documents.

If you have an amendment on the same page with signatures of members (other owners) in the percentage you need I would expect you could file the document with the county and have it be considered legal.

if you want to be sure how to go about it, ask a local attorney for an opinion ($300-$500).

BobC20, what, if anything, do the CC&Rs say about amendments? If the CC&Rs are silent about amending, then to amend the CC&Rs, my understanding all who own land covered by the CC&Rs will have to agree to the amendments.
