Hi,
My HOA met last week and decided to ammend some of the bylaws (specifically, we decided to add some rules regarding pets etc). How do we legally change the assocaitions bylaws? I live in Oregon.

Does you CC&Rs already have wording about "Pets?" If it does, then all your B.O.D needs to do is to add something to your Rules and Regs. If you do not have a covenant reguarding any "pet" language, then you will need to have this as an amendment to your ByLaws, which will require a vote by all of the residents. If it passes by whatever percent that your docs require,then it is recorded as an amendment to your docs with your county of residence. This cannot be a "hand count" , but instead a proper, legal vote of the association.

The condo complex I live in is very small and consits of five units.
All the unit owners in the complex are on the board of directors therefore at the meeting, all the unit owners were present (basically that means the board and the community are one in the same). We as a board voted to add rules regarding pets that are not in the bylaws or in the cc&r.

JulieJ - Very interesting COA setup. Truly the most democratic one I have ever read about. Virtually eliminates any "we vs. them" owner to Board mentality. What's good for the Board member really is good for the community.
