A couple of our owners wish to bring up some topics at our open Board meeting. Should these topics be placed on the agenda, or should the owners bring them up at the Open Discussion portion at the end of the meeting? We're in New Mexico, if that matters.

Who sets the meeting agenda? If it's the board, have you tried asking who prepares it (usually the president or secretary, perhaps both)? Otherwise, just bring it up during the open discussion portion - that's usually where new items are introduced.

Remember that bringing up the subject doesn't mean the board is mandated to take action immediately - some may require research to be presented at the next board meeting, and then they can consider what to do next.

If significant, request, in writing, the Board add it to the agenda. If minor, just attend and discuss during open forum.

If the Board refuses to put it on the agenda, get several folks to attend and stand with you during open forum.

An agenda item is official business.

If residents want to raise a topic during open session, don't expect a vote on any action.

George gives good advice, Rosalie. But if you present it in open form, as noted, you man y not get any any c action (partly depending on your states' laws). So ask th board to please place it on the next agenda.

It does matter. Neither the New Mexico Condominium Act nor the NM HOA Act give owners the right to have an item added to a board meeting agenda. There is an outside chance your HOA/Condo's Bylaws say something on this. Check the Bylaws.

Else you can ask, but there is no legal obligation for the board to put this on the agenda. Discussing this during the open discussion period is worth a try.

For the annual members' meeting, you can make the request again. Be very specific. If you want a vote on something, you should indicate that a motion will be made.

If the item is important to many of you, review your HOA/Condo's Bylaws for what it takes to call a special meeting, where this item is Thee Topic to be discussed.
