Aloha all. I was recently given written warning me to remove my Hawaiian flag from the window of my condo. Florida statute states that an American flag, Florida flag, Navy, Army, Air Force, Marines, and POW flags are permitted. Are there any laws for or against displaying out of state flags? I would love to be in the right on this one. Mahalo for your input.

You could....

1. Fight it all the way to the supreme court and spend thousands.
2. Comply.... because you live in an condo and need to follow the rules without shaking the boat

Don’t let that HOA force you to remove something against the rules you agreed to.

Take them to court! Force them to accept and glory in that spirit of aloha.

And, be ready to write some big checks.

Kind of tacky in the window. If you want to fly it put it in backyard. if you look up there are rules to properly fly a flag. It is not just a HOA thing.

My thing is: if my blinds are open how can they tell me how to decorate the inside of my house?

Yup. It's not unusual to have restrictions that require white windows blinds or require all window treatments to be white or backed with white liners. It's how condos roll, and buyers agree to abide by these restrictions when they sign all those papers at closing.

My HOA has that rule. ONLY White shades in the front windows. Also No signs except for: For Sale/Rent. Put something in your window people passing by can see is then for PUBLIC viewing. Which the HOA can restrict.

Put the flag inside the window facing the inside of your home. Simple as that.

If this were not a condominium but still a HOA, then Florida statute Chapter yada 720.304 states in part: "The homeowner may further display in a respectful manner from that flagpole, regardless of any covenants, restrictions, bylaws, rules, or requirements of the association, one official United States flag, not larger than 41/2 feet by 6 feet, and may additionally display one official flag of the State of Florida or the United States Army, Navy, Air Force, Marines, or Coast Guard, or a POW-MIA flag. Such additional flag must be equal in size to or smaller than the United States flag." I do not see similar wording in the condominium statute, Chapter 718 yada.

JulianW, you are not "in the right" on this one. Take the Hawaiian flag down.
