I have a below ground den in my townhouse. It was flooded by water from a broken pipe outside the unit. Does the HOA have any responsibility to restore the den to it's prior condition? Neither the HOA's nor our homeowner's insurance covers below ground rooms.

Well if insurance doesn't cover this, then sounds like your responsibility. The HOA most likely may not pay for it if not covered by insurance. They depend on your insurance to handle such things. Sounds like you now have an underground swimming pool.

The HOA liability insurance should be covering the damage (expecting that the pipe breakage was caused by something other then an act of God).

Water entering from outside the home can be tricky as most insurers won't cover. You would need flood insurance for this.

Might be time to talk to an attorney as you may need to bring action against the HOA to have the repairs made.
Just because the insurance won't cover doesn't mean that there wasn't negligence on the pipe breakage.

In our community, the HOA covers pipes from the point they leave the unit, but the owner would still be responsible for inside damage. You should check you documents and may also need to ask if there had been problems before, were they fixed, and how long ago it occurred. Perhaps no one knew there was a problem or the pipe is worn out - and decided to break with you living in the unit.

My agent told me water damage and sewer backups usually aren't covered by regular homeowner's insurance policies and so you need to add a rider for that, which is what I did a year ago (I live in a townhouse). For this incident you and the association may need to split the repair costs and after that, the board should ask the master policy about adding coverage to those pipes. Whatever happen s talk to your agent about adding coverage to your policy.

Was it added illegally? Not permitted. Not insured.
