Is it a conflict of interest for a board member to owner units and rent them out and serve on the board which he has great influence on decisions. And also serve on various committees that also make decisions?

ReneeP - No, it is not a conflict of interest for someone to own as many units as they are permitted to own. If you have restrictions on the number of rental units and the Board member purchases and rents in excess of those restrictions than you may have an argument, though not sure how legal the argument may be.

The Board member has no greater influence than anyone else who has the right to purchase more than one unit. The Board member should not be limited by his/her rights to vote because others can't afford to purchase more than one unit. As for serving on committees, if others don't volunteer like this Board member has, than shame on them for not getting involved.

Many times, the appathy of owners is what is the biggest problem to running a successful association. If this rental owner is holding multiple offices and responsibilities, it is bacause no one else is running for office or volunteering. Our association in Florida has 565 homes. We have 4 or 5 people attend monthly meeting ExcepT!!! if we mention either money, putting a speed bump in or getting rid of something. Then they flock until the house is full. So it isn't that this guy is doing something wrong, but because the jobs are there and open for the taking. Get your people involved for a better checks and balances of the goings on.

Please do not make HOAs socialistic playgrounds. Jump on the BOD and you will be gratefull for people smart enough to be on the BOD that own multiple units. Who cares how many or even why thats his or her business alone. Join the bod instead of wondering what is what.
