I live in a new subdivision in Gerogia. The subdivision is not completely built out yet, 2 years and going! The Developer of the community is also the Property Mangement Co, although they go buy a different name for that service. The problem that we are having is they are doing as they please withthe yearly dues that we pay. Promises are not keept and they donot respond to any of the homeowners concerns. We have make shift "community meetings" that is just some of the neighbors getting together and voicing their concerns to each other. We have to email the PM Co, because they do not answer their phones and then we have to sit and wait and maybe get a response. My questin is this, Since we don't have a functioning HOA yet, what legal action can we as homeowners do to get the PM Co to address the needs of the community. We have broken sidewalks, non functioning lights and water fountains, unfinsished streets, unkept vacant lots sink holes in common lawn area's and so on. All these concerns are completely ignored by the PM Co. We here them the most when it is time for them to collect dues. Any ideas??

Get your county Permitting Dept involved and the county developement and the county commissioners or anyone who will listen to you. The developer has Bonds in place with them. Failure to follow the original plans that were approved by the county, doesn't fly well with the government agencies who are responsible for the growth of your area. Keep calling and writting until you find a responsible person within the local government who responds with help. There are "sheister developers " who want to make a fast buck but haven't got the funds to back themselves up. Then they gradually renig on their responsibilities and the homeowners are left holding the repair bills. And most importantly--DO NOT ACCEPT A TURNOVER UNTIL THE OWNERS ARE SATISFIED WITH THE CONDITION OF THE COMMUNITY.

Thank you Donna, we are going through those exact steps right now. There should be a better way to "Police" these people. They seem to be buried in a very tangle web of different names and corporations. I would think you could go to one governing body and they would be able to help, but so far, just like you posted, we are going to anyone who will listen. Thanks for the advice on the Turn Over, that is what I was afriad of, they would hand over a complete mess to us. We have contacted the BBB, FTC and letters are going out to the County Commissioners office and Georgia Real Estate Commissions Office. It is a lot of work, but we have to do it. Thanks again.

You are welcome. Our Developer on the Platt plans, had agreed with our County, to install "Grade 1" Oak trees along our parkways(street side strips).This was over 400 trees. A year after turnover, the trees were all looking very bad and very diseased. It took me 11 months of having arborists and so called tree experts, come and examine them. The opinion was that the trees were all of a poor grade #3 and were not in compliance with the original approval. No help there. Then I remembered that the County Engineering Dept. and the Urban Environmental had signed off on the original platt. It took some pleading but guess what. The trees were addressed and all was taken care of to our satisfaction. Moral of the story is to get someone who is devoted to work on this and keep going after them. It is hard work but it puts a huge smile on your face with getting satisfaction

In addition go to your city folks and start in on them they write the permits and do the inspections. They have the tree police and all the other silly things we pay taxes to support. Find a city commisioner up for election or reelection and make nice with her or him. get them on your side wine em dine help get them into the public trough but never eevr let them forget who put them there. It works for us it beats the hell out of massive attys fees in your budget!!

THIS INFO IS FOR ALL WANTING TO GET RID OF PROPERTY MANAGER AND BOARD NOT FOLLOWING THROUGHW/CONCERNS,COM-PLAINTS. I HAVE BOUGHT A CONDO IN R.I. 10MOS. AGO,SINCE THAT TIME I HAVE MET MANY OWNERS AND RENTERS,WE THE OWNERS GOT TOGETHER AND DISCUSSED CONCERNS IN REFERENCE TO BOARD,P.M. ABOUT 3MOS AGO WE FORMED A QUORUM 20% OWNERS VOTED TO HAVE BOARD,P.M. REMOVED. THE WAY WE GOT THEM OUT WAS THEY FAILED TO HAVE A ANNUAL MEETING. THE YEAR BEFORE THEY HAD ONE AND DID NOT HAVE MINUTES. WE HAD A MEETING INCLUDING NOTIFING ALL OWNERS INCLUDING BOARD OF TIME,PLACE,DISCUSSION. WE HAD 15 OWNERS AND 4 PROXY. WE VOTEED AND REMOVED OLD BOARD ,WE CONTACTED A NEW P.M. AND ACCOUTANT TO BE PRESENT AT THE MEETING. THIS WAS ON AUG 28,2007. ALL OWNERS SHOWED AND OWNERS THAT DID NOT SHOW SENT PROXY. WE ARE VERY HAPPY TO SAY WE ARE NOW MOVING ALONG. THE OLD P.M. IUS BEING INVESTIGATED FOR NEGLIGENCE,MISAPROPRIATE OF DUES,AND WE ARE QUESTING THE P.M. RIGHT TO BE A P.M. REASON: P.M. IS A OWNER AND ON THE BOARD HE CHARGED 850.00 MONTHLY FOR SERVICES THAT HE DID NOT PROVIDE. ALL WORK THAT WAS DONE WAS MOSTLY DONE BY HIS OTHER CO. THERE WERE MANY FEE'S . WE NOW PAY 690.00 MONTHLY,WE THE NEW BOARD DEAL VERY CLOSELY W/ NEW P.M. WHO BY THE WAY IS A WOMAN BASED COMPANY. WE THE BOARD ARE ALL WOMAN ALSO. YOU WANT A JOB DONE RIGHT HIRE A WOMAN. OLD P.M. IS NOW ANSWERING TO WOMAN ON A MISSION TO MAKE THINGS RIGHT. WE INCLUDE ALL OWNERS IN DECISIONS. NOT JUST A FEW . EVERY LOVES NEW BOARD AND IS MORE THAN WILLING TO HELP IN ANY WAY. THIS HAS NOW BECOME OUR 30 UNIT COMMUNITY.
