Several homes in my neighborhood are owned by a large vacation homes management company. Because they never attend HOA meetings, vote by proxy, etc., we can never have a quorum, and therefore can never accomplish any significant changes for the better of the neighborhood. Does anyone have advice for an issue like this? Thank you.

Has your board asked to meet with the board rep of the company?

Given the company has an interest, they should respond?

Your problem is in a complete contrast to what most homeowner boards complain about with Proxies IMO. Usually you would see this this type of Management Company try to control things to benefit their interests and not the HOA or it's homeowners. This seems like something that is very easily worked out and should have been done as soon as it was noticed. A friendly note from the Board President requesting a phone call or face to face meeting with the board. Everyone has the same vested interest in your HOA.

Are you aware that FS 720.306(1)(a) mandates a maximum of 30?% of the voting interests required for a quorum? This overrides whatever figure is in your governing docs, unless your governing docs specify a smaller value. Will that allow your membership to attain a quorum?

A Proxy can be used for several things including establishing a Quorum. The Proxy just has to say what it is used for. So the answer to establishing a Quorum is their Proxy says it can be used for such. Might be as simple as the BOD to work with them to accomplish this.

That said, maybe the BOD does not want to establish a Quorum thus no BOD elections can be hald and the BOD stays in place. Could your BOD be doing this?
