Ae there any legal findings that says we can or cannot have alcoholic beverages by tenants at the pool or at the clubhouse? At present, we do allow tenants to have alcohol at the pool but have said no to bringing alcohol into the clubhouse.

Sometimes you have to pick your battles. Most HOA strictly prohibit glass in the Pool area for the obvious reasons. Alcohol can be carried by many ways into these areas. Think of all of the Yeti type cups on the market. What would you do hire someone to smell drink containers? Search people as they enter or random checks? You will be accused of selective enforcement every time.

But be sure to check with your insurance agent first to see what the HOA's potential liability is and to make sure you're adequately insured.

Our rule is no glass bottles at the pool/clubhouse area. (They are attached). Alcohol comes in glass bottles so that would indicate not to bring it. However, you could drink a beer in an aluminum can or pour your drink into a plastic sipper cups. Just not recommended open solo cups.

Our city has an "open container" law here. So it's not really a HOA rule as much as subjected to public laws. Which if the police were called and saw you with an open container you could be ticketed or arrested. There still are public intoxication laws. So a drunk person could be subjected to that.

The no glass no liquor rule is a heath department regulation, whether you want to be strict and enforce it is another story.. Red Solo Cup!!!!

Adults use our community pool always have a plastic water bottle or other plastic drinking container. Yes, myself I have brought a rum & coke, wine or a beer in my plastic tumbler.

It only becomes a problem when people get boisterous and the alcohol starts talking and security or the police are called.

We do enforce the no smoking rule, no smoking whatsoever. we had a couple that brought a hooka bong to the spa, after being told not to light it by another owner, they ignored him. The owner called security, filed a complaint with the HOA and the offender was fined by the HOA.

When it comes to HOA sponsored community events, the only beverages served are soda and water NO beer or liquor,

I think an official policy "forbidding" alcohol is wise at the pool area and in the clubhouse but it's really unenforceable. However, a clear "no booze" policy puts the onus on the pool and clubhouse user to abide by the rules or to use clandestine measures to avoid detection and thus be overtly flouting the policy should something happen that could raise a legal stink.

Fight glass at the pool without regret.

Fight open drunkenness at the pool, which can sneak up on people sunbathing in summer.

Thanks for ur comments... Some issues we will have to work with... At the moment,glass at the pool is strictly forbidden...we will have to work on it as it pertains to the clubhouse
