Hi Everyone,

Our subdivision is very small (only 40 homes) and is approximately 1 acre back from the main road. The three pre-existing homes that are directly on the main road would like to be a part of our homeowners association in exchange for allowing our "front entrance columns" to be placed on their properties' right of way.

Is there anything that has to be approved through the City to do this, or can we simply amend our covenants to include those homes?

We aren't actually within the city limits of our town, but we are considered a part of the community.

Anyway, any advice would be appreciated!!

Laura, you can annex these three properties into the association. I would involve an experienced HOA attorney to assist. If within the jurisdiction of a City and/or a County check with them to determine their requirements.

Roger,

In Colorado could an HOA annex in a property that is bordered by the subject HOA
on the east and south but is in a different platted subdivision? Both are rural
sudivisions?

Alan, check your Declaration of CC&Rs. Normally annexing is allowed. Both parties must agree in accordance with their CC&Rs. I would utilize an experienced HOA attorney, such as Tom Hindman.
