What is the notice requirement for a meeting titled "Budget Meeting"?

Is it a regular BOD meeting with Budget on the Agenda?

If only Budget is to be discussed is it a special meeting?

Is there any special notice requirements involved here?

The BOD here has been less than responsible with meeting notices in the past.

Yes it is a regular BOD meeting, there are no defininition in 720 for budget meetings. A special meeting is a non-regular meeting to discuss something like a special assessments. The notice of a regular meeting is required 48 hours in advance of the meeting.

There are a lot of changes inacted in FL720, July 1, 2007. There are a lot of new particulars that were added pertaining to the budget and reserves. I would read these very carefully and make sure you have the disclosures and procedures that are now required.

This is from 720:
"An assessment may not be levied at a board meeting unless a written notice of the meeting is provided to all members at least 14 days before the meeting, which notice includes a statement that assessments will be considered at the meeting and the nature of the assessments."

Our documents refer to our dues as "annual assessments" so I consider any board meeting where we are voting to change the annual assessment to require a 14 day written notice.
If we are just reviewing the budget and not voting changes to the assessments we do the 48 hour notice only. We ususally review how we are doing in comparison to the budget every couple of meetings just to make sure we are on track. I don't consider those meetings to require a 14 day notice.

You do not need to have a special meeting to "discuss the budget" they are not voting. 48 hours suffices as notice.

Absolutely right. A 14 day notice must be given for any adaptations of budget or assessment changes along with amendment changes.Also, annual meetings are included in the 14 day prior notice. It must be posted. Regular Board meetings require a 48 hour notice

Hello, original poster here.

The meeting is to be next month and is called a "budget meeting". It is not coinciding with the ANNUAL meeting scheduled for Dec. So... if they are in fact setting next years budget and intending to vote on it next month as I believe, and...given this additional info. now, what do y'all think the required notice time should be?

Is this a flawed practice? Does it force the next BOD to be seated in Dec. to accept it?, etc.

Along with the 14-day notice, don't they also have to send a copy of the proposed budget that is to be voted on?

No, you do not have to send a copy. A copy has to be made available to each homeowner as per 720. We send a copy of the budget with a notice of the meeting time and date. A notice is also made on our private channel and a board at the entrance to the community. Rules have changed for the budgeting process in Florida. Most of the new laws pertain to Reserve accounts. Don't forget these new laws.
