We have a condo unit which has been abandoned by the owner. Our concern is that thee electriciy has been turned off . Can we have a locksmith make a new key? We need the electriciy on because it runs a sump punp for that building. This owner is also over $3000 behind in association dues. Thank you.

Keith, check your CC&Rs. Usually they provide the right to enter the property. I think you are justified in doing so under the current conditions.

While a lot of condo documents allow the BOD to enter the property to cure violations or remedy safety violations; I would not just call a locksmith and enter. First can you determine if there is power to the sump pump without entering the unit? Then I would consult with an attorney to make sure you have the right to enter for this purpose and to make sure it is done correctly, to prevent charges of trespass. Finally if you do enter the unit I would video the entire process so you can prove you did no damage to the unit.

Why would a sump pump be a unit's responsibility and electrical expense? That is strange situation. If your only concern is if the electric is on, why don't you call the electric company? Why are you wanting to spend association money to get inside? I would think you'd be more interested in recapturing the $3,000 due you. Harold
