I am a landlord and I have a tenant who is living in my condo for 4 years. If she has a water damage in that unit, can she present a claim directly to HOA insurance company? Should I buy a special insurance for her? Board of Directors advised me that the tenant is not eligible to be compisate from HOA insurance becouse she is not an owner of the unit. Is it right?

The tenant cannot present the claim but you can as the owner. She should have apartment insurance naming you as the landlord within the HOA building. She has to purchase this. Is the HOA saying that they will not put the claim through their insurance policy because a tenant lived there?

You as the Owner should carry an HO6 or HO13 policy covering what is yours according to your CCR's. In your lease agreement you should require that every tenant cayy "renters" insurance which would cover their personal belongings.

If the water damage you are speaking of has damaged your ceiling or floors, let's say, then you as the Owner should report not only to your insurance carrier, but go through the HOA MC or board to report what would be covered under the policies.

In Townhomes and Condo's, I always recommend the Owner to carry appropriate insurance covering what is their obligation to repair, where the HOA's policy would stop. All of that would be according to what your CCR's read. Bring your CCR's to your insurance agent and they can help you carry the right policy. Most important write into your lease the renter must carry their own policy.
