Hello! I live on the 2nd floor of a 2 story condo building in California. The unit below me just sold to an investor who will rent out the unit. The previous owner did NOT have an AC unit (we are NOT allowed window units), it is all central air. Even though the previous owner didn't have an AC unit, it was wired for one with installation in the rear on their patio. My AC unit is on my rear balcony. It is a small old unit, only 1' high. I come home last week and a 3.5' high AC Compressor was being installed under my stairs, just below my front door. I immediately asked if they had HOA approval. Of course the owner was not there. The very next morning I call the HOA and they said YES, the Arch Comm did approve it.
Over the weekend it was 95 and the tenants have turned on the new unit and just as I suspected it blows all the exhaust right into my home. As well as the 1st floor neighbor beside them whose bathroom window is beside the AC Compressor. My downstairs neighbor does not have AC and I have a fairly old unit, which I rarely use. My front door faces west so I get an ocean breeze. The 1st floor neighbor is just as upset as I am and can no longer leave their window open.
I have requested a meeting with the Board and I plan to ask if the Arch Comm even walked to the front of my property to see how close the AC unit would be to other windows and doors, as well as if the owner was honest in how large the compressor would be. Conveniently, it is around the corner from the front door of unit it is cooling so they don't have to deal with any of the exhaust.
My solution is to have it moved to their back patio which it should be in the first place. But I think the owner didn't want it there because it would have to be installed right in the middle of their patio away from their wall and window.
Has anyone else had success in asking the Board to change the decision of the Arch Comm? I hope the Board will be sympathetic to myself and my 1st floor neighbor so we don't have to have exhaust blow into our homes.
