Clubhouse Furnishings

The Declarant is still building houses in the development. The Declarant turned over the HOA to Owners one year ago as per the Covenants "10 year" rule. Construction has now started on the Clubhouse. Question: who is responsible for furnishing the Clubhouse: Developer or HOA? The Clubhouse will have a general use room (furniture), exercise room (equipment), and a large patio adjacent to our Pool (patio furniture). The Pool and Park have already been deeded to HOA. I expect the Clubhouse to be deeded to HOA upon completion.

Are you on the board? If not, I'd ask them. The developer was a member of the board until turnover, so the remaining members should know.

If you're on the board and don't remember this being discussed, you may have to ask the Developer or dig through your HOA's paperwork. There may also be documents online somewhere that lays out the Developer's obligations and plans for the community. I'd expect these documents to be on your county's web site if they maintain public records there, since developments like this go through many rounds of permitting and approvals. However, plans can change depending on economic conditions, so you need to make sure you're seeing the most current records.
