I started this thread per the request of JohnC46 (South Carolina). John wanted details on the creation of our HOA.

There's not a lot I can say as we hired an attorney to advise us and file the necessary paperwork. This was done over seven years ago.

As part of a legal settlement, we formed a new HOA. Our attorney advised us and walked us through the process of creating the Incorporation and Declarations documents. We created the required articles (based on input from the attorney) and adapted variations from similar communities for other aspects of these documents.

We also drafted the ARC guidelines.

We had a lot of: 'we like this', 'this is too restrictive' type of discussions throughout the whole process of all the CCRs.

The attorney handled all the necessary filing of paperwork for the new HOA. I can not offer any advise with regards to that process.

I served a Board of Director member for most of the seven years. These CCRs have served us well in managing HOA.

That's really all I have as information on the formation of our HOA. I hope you find it useful.
