I hope someone can help me with this. Our Developer when setting up the orginal by-laws excluded himself from paying any association dues. He still owns 4 lots and has 1 vote per lot, can this be changed where he pays his dues or he is excluded from having any right to vote.

Our election is coming up an several members feel he should not beable to vote if he does not pay dues.

Question? Is he still in control of the HOA? If he is still in control and hasn't turned over the HOA to the owners then he may be able to "excuse" his association dues. However, if the association has been turned over officially, then the developer becomes a typical "owner" with the same rights and rules as any other owner.

My suggestion is if the HOA has been turned over to the HOA, then the HOA needs to follow the rules in changing their CC&R's and By-laws. It should eliminate the developer's references and update the rules the owner's want in place. It won't be cheap but it may be worth it in the end.
