Up until right before we took ownership of the house it was communicated to us that the land in between our house and next house would be a paved driveway for the turnaround (this was even drawn on the floor plan of the community), hence one of the reasons we choose this lot. However, when moving in they planted Bahia grass instead. They cited an impervious ground constraint but when we talked to Seminole county this would not have been issue. We then at least asked for matching Saint Augustine grass because we had a huge patch of dead brown grass in the middle of our houses and they are refusing. Now my new concern is that is Bahia grass is a weed it can take over our Saint Augustine lawn grass. When I brought up this concern and asked for reassurance that they would replace our lawn if the grass ruined our grass they said they would not pay to fix our grass!

Overall Question: If their decisions causes our grass to be ruined wouldn't they be responsible for fixing it? Thank you in advance!

What came first the chicken or the egg. Honestly, you planted the St. Augustine grass. The HOA on their land planted the Bahai grass. It's their land to do what they like. It's your land to do what you want. My question is what if your grass grew into the HOA's grass and they demanded you pay? What would your answer be?

ACTUALLY, it was their decision to plant the St. Augustine grass. We had no say when building the house what the landscaping would be - they choose that grass.

To answer your question, it is necessary to unbundle a number of sub-issues:

1. Do the governing documents require you to have St. Augustine turf (many do) or what that your choice of sod?

2. When did the bahia grass get planted w/r/t your acquisition of your property? Before or after (I presume after based on the facts you have shared).

3. What does the recorded plat designate this strip of land as? Do the governing documents speak to this issue?
