mowing developer owned property

The HOA has been mowing some landscape for the past five years that belongs to the developer. It now wants to cease mowing this property and negotiate repayment from the developer. Any suggestions? Jean

Question? Is this HOA homeowner controlled or developer? Is the developer a homeowner/member of the HOA? Doesn't make much sense in stopping mowing this property unless it's not part of the responsibility of the HOA to maintain landscaping/mowing.

To try to bill him for past months or even years seems a little petty. Or is it a lot of $$?

If no, why is the HOA mowing it?

If they are mowing it for no reason, why would someone pay the HOA for something they didnt ask for? If you mowed my lawn and then asked for money, I would tell you where to stick your bill.

When the developer is still in the picture, usually the developer IS the HOA, or at least controls it through its ability to appoint directors to the board. If there's some other arrangement in place then a few more details about it would be nice to have.

The cost of mowing that lot is already part of your landscaping expense contract and budget. I bet you don't save much money by removing it unless it's a large parcel. The HOA board should weight the aesthetic price of pulling service from that piece of land if it's likely the land will sit permanently undeveloped. And one last thing, forget seeking back payment for grass your HOA willing mowed and funded.

The developer won't care how high the grass gets. The dues payers might.
