I never really understood the 1 car in the driveway and 1 car in the garage thing, and the bylaws say up to 4 people (and some units up to 6 people) can live in one Unit. Since there are only 2 parking spaces per Unit, what was the thinking of the Developer (or whoever made up the rules)? Did they expect the other tenants weren't going to drive, or perhaps be Children, or perhaps they could park on the street?

It is not out of the realm of possibilities that your set of CCR's is a "canned" set that may be used for multiple HOA's without any law firm setting forth on the property, nor having a clear understanding of what the developer was acting attempting to accomplish.

Mmmm... Follow the bouncing ball... 1 car in the garage allows parking out of site and maybe room for storage. It depends on the size of your garage. The 1 car allowed outside on the driveway allows for visitors or extra cars. This is a typical needs for the "nuclear" family.

Many HOA's are what they call for "Newly Wed and Nearly Dead". Developers make HOA's to accommodate that. Newly Weds need only 2 cars. Nearly dead only 1 as they don't drive as much. If this stereotype is true is not for me to judge. It's just the logic used when deciding certain rules/setup of some HOA's.

If you don't like rule and many others don't, then you all can change that rule if you want. It's all in your documents on how to do it. Oh and it doesn't take a lawsuit to do it...
