Can any HOA in California assist me? The state of California has an antiquated law on the books that requires HOAs to post a 96 hour notice prior to towing a car, even with restrictive parking signs. The fine to any HOA board member for towing a car without giving this notice is $1,000.00

Davis-stirling.com is a website by a CA HOA Law firm. Visit it & go to "Vehicles and Towing." I believe the info you provided is partially correct but incomplete.

For instance, the 96 hour notice is for cars in violation of your rules parked in the common areas. If a car is parked in my personal underground parking space, I, the Owner, may have it towed immediately.

If a car is parked on HOA property in an area designated for emergencies, it can be towed immediately.

Even if your HOA must comply with the 96 hour law, your HOA can still have a written procedure of hearings and (hefty?) fines for breaking parking rules to deter offenders.

The only problem we have is abuse of guest parking. We only have two parking spots for guests, we're only at 12 unit HOA. I found two decades worth of minutes of HOA meetings- guest parking has been a problem for over 20 years, I think I know how to take care of the problem. During our meeting next month I'm going to suggest that if we fill the waiting list for a second parking spot with the two guest parking. It will add $2,400.00 to our income per year,and do away with all the dissension that has been going on for the last two decades.

Thank you for your advice about the stiff fines and penalties, we spoke about that during a recent conversation. Great idea, and I appreciate your response.
