spending on public roads without a contract with county

I am confused about why you need a "Contract" to establish this? Don't think this is a contractual thing. It's more of a right of egress or something along those lines. It sounds like your HOA is making itself seem private in some way. Is it gated? Limited entrances? City/county lines blurring?

I don't think our county maintains the roads like our city does. The county would sooner throw down oil/gravel than pave. This sounds more like a local issue with the county on how they do business. Like when we first built we were in the county. Fast forward 20 years and we were incorporated into the city. Our roads were at the "county" standard. Which means our streets are not wide. The streets were private so got away with that. Once we became city the roads needed to support 2 way traffic and parking. It was our responsibility to do that. Instead we just made it no parking on one side of the street. The county/city wasn't going to widen our roads for us.
