We are 1050 homes and have a tennis court. The Tennis Club is 25 members with 15 active. They wish a rule that says the court can only be used for tennis. 1025 homes are excluded from the use of the court because they either don't play tennis or choose not to play. Can our HOA write such a rule?

The Board can enact such a rule if they are empowered to do so. Is it the right thing to do? Possibly not.

I am aware some tennis courts in our 9000 home association have been converted to dedicated or shared pickleball use. I can envision a scenario in which days/times could be set aside for that and other uses which do not damage the surface of the courts or the equipment

What those uses might be, especially here in north Texas in the summer, I cannot imagine but there are many participants in these discussions with vast experiences. More than one may have suggestions.

What the Board should do is establish a schedule for tennis and alternative uses, and define the alternative uses which are acceptable.

i could see adding a rule that you can't use the courts for any activity that damages it - ie riding bikes. But you can't restrict people from playing pickleball or anything else that is normal use for it.

I agree with CJ that damage to the court would be a reason to limit its use, but I don't see how this rule would exclude anyone. It's like a swimming pool - some people choose to use it or not, which is their choice.

This sounds like some people are pushing back because they don't want to pay for something they don't use, but HOAs don't work that way. Everyone has to pay assessments to cover the maintenance and repair costs of the common areas, including tennis courts - this isn't a cafeteria, where you choose to pay for some services and not others. Now, if this club is trying to say you have to be a member in order to use the tennis court, that may be a different question.

My understanding of the OP's situation is this:
- 1050 homes
- one tennis court
- all homes(through payment of their assessments) contribute equally to maintenance, repair, and eventual replacement (reserves) of the tennis court
- 25 homes formed a "tennis club"
- "tennis club" want a rule that states the tennis court is to be used ONLY for tennis

Rules preventing use of the tennis court in a way that might damage it should certainly be created (e.g., no bike riding (if tires leave marks on court), no roller blading, no skateboarding, no spikes or cleats, no hockey, etc.).

However, rules that would completely prevent its use in other non-damaging ways (e.g., basketball, handball, other ball-related games, jump-rope, etc.) should not be created since they are preventing acceptable use of an HOA-owned amenity. Further, it absolutely necessary, I could see a use schedule being created that permits acceptable times that tennis-only can be played and times that other activities may utilize the court.

In a similar manner, one could not take the community pool and create a rule that states the pool is to be used for ONLY lap swimming. That would unfairly prevent it's use by those who just want to be in the water to cool off, splash and play, etc.
