In the past year it seems like the renters are taking over our condos. They dont want to follow the rules. and continue to do what they shouldnt do after a hearing they get fines piled up. and the owners come after us saying we are in the wrong and the rules need to be changed. AGHGHGH.. This is backwards. How to get a grip on renters with owners who are afraid to tell them what to do because they dont want to lose their rent money. So they get a lawyer tell us we arent doing things right for the hearing and to top it all off their lawyer sends a letter to us on friiday afternoon knowing our meeting is on Monday. This letter says I will be at the board meeting and discussing this issue with the association. BAWAAASSSS.. Sadly we are canceling the board meeting and telling this lawyer we will have the meeting with our lawyer and you.. And this lawyer that sent the letter is a realtor lawyer whose letter proved knew nothing about condo law. Must of been a freind of theirs. Renters .............Any ideas how to handle renters.

We had to put a stop to the amount of rental properties in our complex. Our CCR's were updated after being 30 years old. One of the stipulations is that any new owner must live insight for 2 years prior to renting. That stopped the investment people from buying and slowed down the rental units. Suggest you look into this if this a big problem. CLost to 1/3 of our building is rentals.

Majority of the renters are respectful the others have known lazy landlords that don't even hand out the rules to the association with each renter.. Some renters just think this is another apartment building and wonder why they can't have domestic disputes and not have the cops called on them. The majority of times when something big is going on with a unit.. 90T% of the time they are renters. a good portion of them don't know the rules. and the rest just think thnk this is another apartment building with onsight management!! I had one renter come to my door asking if I was the manager! NO kidding.

1st off do not hire a Real Estate Lawyer to handle HOA issues. Your not dealing with Real Estate. It's all contractual or corporate law.

2nd each state has different laws on allowing rental restrictions. It's wide ranging so best to do your own research for your specific state in regards to limits. Will tell you a majority of states don't allow HOA's to restrict rentals since they don't own the house/property directly.

3rd the best way is to have landlords write into their lease agreements that renters MUST obey the HOA rules. The HOA can't necessarily enforce them onto the renter directly. They have to apply them to the owner. The owner feet is to be held to the ground for their renters. Having the caveat to obey the HOA rules, allows the landlord to be able to evict their tenant for violations. Otherwise "Tenant's rights" kick in. Which if the tenant isn't in violation of the lease agreement the landlord can't evict them. Having this written into leases protects ALL parties involved. The HOA can hold the owner responsible which then allows the landlord to evict.
