I own and live in one unit in a nine unit condominium. Recently our Board President has listed her condominium for sale, but not stepped down as Board President. Does having her unit for sale and being Board President present a conflict of interest? To me it seems the logical thing for her to do is to step down but she has refused to.

She is still the owner of the unit correct? So why does she have to step down because of a For sale sign? My HOA I bought another house and moved out completely. My HOA house became rental property. Still qualified to be President. However, I had already decided to resign and become just a board member once elections came around.

I assume that you are like most Condos. Any owner can be a Board member. The Board members decide who will be the President.

She still owns the condo until she sells it. So she qualifies to be on the Board.
If the other Board members don't want her to be Pres, they can elect someone else to that position.
If they haven't voted someone else to replace her as Pres, then I assume they believe that she is still adding value to the organization.

Some associations don't even require directors to be owners. See your bylaws for details. If your bylaws don't require directors to be owners, the president could stay on even after she sells.

As others have said . . . there is no conflict of interest and no logical reason to resign as a Board Member or President while her house is for sale. I applaud her refusal to resign amidst apparent pressure for her to do so. As long as she owns the house, she is a member of the association, and entitled to be a Board Member.
