We are a Texas subdivision of 70 homes. About 50% of the homeowners are deliquent in their dues. The BOD wants to become more strict in collecting these outstanding dues. We would like to start with a warning letter and then impose liens if necessary. Can anyone help me with information on the Texas lien process.

Gary, I suggest you look into establishing Rules and Regulations on Delinquent Assessments. To encourage prompt payment of assessment I recommend your HOA establish a stiff late charge per month. You can use the search button for more info on this.

Along with Roger's response, it sounds like you need to send late notices to the 50% giving them a one-time opportunity to pay, giving a deadline. If they do not pay by the deadline (here in NC the Collection Laws and the amended Planned Community Act) states we have to send a Final Notice detailing the amount owed and what will happen if they do not pay, lien, legal fees, possible foreclosure.

I still need to become educated in regards to what the consequences can be, but I think the first warning is a great way to start.

I believe that there is enough verbiage in the deed restrictions to allow for placing liens on the deliquent homeowners. I am just looking for a good source for a texas notice of lien and the actual lien forms. I have searched the internet and have found only mechanics and tax liens, nothing specific to HOAs. Any ideas for sources?
