HOA CCR's strictly prohibits parking on the private roadway as follows: "no parking of vehicles of any kind or nature shall be allowed on the streets or roadway within the plat." "other than temporarily for purposes of loading and unloading of passengers or personal property." Many reasons for this from lack of access to increased traffic on the roadway and of course the biggy which is maintenance, maintenance, maintenance (it costs each of homeowner!)

The roadway is a culdesac in a long rounded rectangular shape. The road is narrow at the front entrance and is posted by Fire Department as a fire lane as well as a posted for towing.

There are 12 houses total - 6 on each side. The road does widen at the end of the subdivision where the last 4 houses are (2 each side). Our HOA has always enforced the no parking due to blocking of entrance, excessive parking in front of homes, blocked driveways because at one point it was so bad the trash company refused to come into the subdivision for trash service with their big trucks (too narrow).

As you know, this "no parking" is a HUGE ISSUE and the complaints are numerous from; 1) I only have a one car driveway and garage where are my guests supposed to park 2) why can't I park in front of my own house overnight 3) I have multiple cars, where am I supposed to park them 4) I have a lot of family where are they supposed to park etc.... etc..... etc..... We do make exceptions, but only when notified prior because life happens, moving of course, vendor vehicles, service vehicles and if there is a life event, i.e. marriage, family gathering, etc...

Thru a lot of work with our HOA attorney the HOA enforces the parking because of the requirement to have consistent enforcement. One courtesy notice goes out and then fines start on an escalating basis.

The issue we have is the is always one or two who blatantly ignore the parking. It happens to be two of the four houses at the end where there is a larger roadway as opposed to the narrow entrance. One has a one car driveway and garage and the other has a two car driveway and garage.

The person with the two car driveway and garage thinks their daughter and granddaughter should be allowed to park in front of their home anytime they visit and should not have to park in the driveway. They say it's too difficult to unload on the sloped driveway. It is slightly sloped and the roadway is flat. HOA stance is to unload and load on the road then park in the driveway which has continued resistance from this homeowner. Then of course they see the other neighbor directly across from them with the one car driveway with a one car garage have a steady stream of cars who park on the roadway. Both homeowners were notified of the parking violations last year and of course were furious. One complied and the one with the single car driveway and garage did not and eventually was fined and the fine was significant. This homeowner continues to have guests and family park on the roadway and recently the HOA was in the process of fining her again when she notified us after the fact that the increased traffic was due to her mother now living there with nurses coming and going. Now the HOA is not heartless but the issue is the two owners of the houses at the entrance and other homeowners feel they are being singled out because they or their guests cannot park on the roadway yet this homeowner always has someone parking on the roadway.

By the way this homeowner has not paid dues and/or continually pays dues late :-(

Place a lien on them for non-payment. Protesting/complaining isn't a reason to NOT pay dues. Nip that habit in the bud IMMEDIATELY.

No means NO, follow the rules or they can buy bigger house with a 6 car garage. Be diligent and keep fining.. It isn't being singled out when one person consistently breaks the rules.
