hi i need help understanding this....i'm about to go to a IDR meeting in a few days now mind u this is my 3rd one in 4 yrs...
its also happening at a H.O.A board meeting....so my question is and yes i tried looking it up....can a IDR be held at a Board meeting??? if so at the beginning or in executive session?? is it private or can anyone attend my IDR??? ALSO note there hasn't been a Board meeting at least not a physical one they have been having them one the phone with no proper notice for years....

If you want your HOA to be "Open", then why not have it at a board meeting? Members do have the right to know what actions their HOA board is taking against potential violators. It would probably be part of meeting notes private or not private. A HOA is run by it's members/neighbor. So it's not like tongues aren't already wagging...

The California Davis-Stirling statute directs that the HOA provide Internal Dispute Resolution (IDR). If the HOA has alleged a violation by you, then it is proceeding pursuant to California Statute 5900 through 5920, as listed and linked at https://www.davis-stirling.com/HOME/Statutes/-Davis-Stirling-Act . Here's a flow chart: https://www.davis-stirling.com/HOME/Rules-Enforcement-Flowchart . It appears you are not required to participate. You will want to read Davis-Stirling statutes 5900, 5905, 5910, 5915 and 5920 . Take notes, especially on where you believe the HOA is violating any of these statutes. If IDR fails, then again pursuant to California statute, the matter is elevated to Alternative Dispute Resolution (ADR), meaning either mediation or arbitration.

I believe it is appropriate that the Board meeting with you be held in executive session. You should contact the HOA manager to confirm.

In my opinion this should always and only be done in Executive session. This is a personal matter between the Board and the Homeowner. When the HO is defending themselves they may have to mention something personal that the Board needs to hear and not the community. I know some might say if they share it with 5 they should share it with all. As Board members we are held to a higher standard and should never talk about Executive session matters.

A IDR is held between a member and the Board. It is held in private, not necessarily in Executive Session as there may be less than a quorum present. There should be a minimum of two present on each side. Parties are now allowed to bring attorneys to the table.

You should contact the Board through the HOA manager.
