We are an established community of single family homes, townhomes, and condos. After many, many years there is some interest in developing a parcel platted for 48 one story townhouse-style condos. Our Architectural Guidelines do not address builder fees for this type of construction. Assuming there will be 8 six unit buildings should the builders refundable deposit and non-refundable impact fees be charged on a per building basis or a per unit basis?

What does the actual Declaration of Protective Covenants and Restrictions state ?

Where is the 'architectural committee' authorized to 'charge fees' ?

Have you actually read and studied ALL your 'governing documents' AND state law(s) ?

What does your 'corporate attorney' say ?

My internet answer is NO, you may not charge ANY fee based upon architectural committee request.
